About Me

Scott Whitby is a senior, experienced business lawyer in the Calgary office of Miller Thomson. Prior to joining Miller Thomson, Scott held the position of Associate General Counsel to a Canadian based, multi-national chemical manufacturing corporation. In this role, Scott advised both management and directors on matters within his specific area of responsibility, including matters of compliance and litigation strategy and management. Scott had specific responsibility for providing commercial and legal support to the chemical sales team in the drafting, negotiation and completion of chemical sales contracts, to the rail terminal business unit in the construction, development and operation of a pipeline connected “crude by rail” transloading facility, and to the corporate/business development teams in relation to acquisition and divestment activities. Prior to this in house counsel role, Scott was engaged in private practice in both Saskatchewan and Alberta for over 18 years, holding progressively senior positions within major national and regional law firms, including senior practice group and business development leadership positions. During his private practice career, Scott gained extensive commercial and energy law experience, primarily in relation to the acquisition, construction, operation and divestment of mid-steam assets, including pipelines and processing and storage facilities. He advised and assisted on numerous asset and share acquisition and divestment transactions as well as many corporate organization and re-organization transactions. Scott also has significant experience advising both E&P and oil field service companies in relation various commercial matters, including acquisition and divestment activities, as well as First Nation controlled enterprises in connection with commercial matters relating to the development of oil and gas assets.
